It seems he’s too powerful to kill with the few resources they have. The only reason they can even hold him the way they are was mostly explained in some of the older comics that aren’t here – basically, the unicorn sealed his black magic (we saw this), an herbalist or something in the last town set up a concoction to block his mind domination powers (old comics, not sure if the concoction is something given to his guards or just force-fed to him), and later comics indicate that his white magic curse on Typhan-Knee was so powerful, it’s had other (unstated) side effects, probably cutting him off from using white magic at all.
Later comics will show this, but even cutting off his head doesn’t kill him. His magic is just THAT powerful. The best that any of the party here can achieve is to seal his magic internally.
As to why they don’t just cut out his tongue or something and ditch it in … a ditch, or something – that, too, is explained in later comics.
I don’t know which option would make that knight in panel 3 stupider:
1) that he truly doesn’t know that they’re not going to sunbathe; or,
2) he knows but still asks the question after seeing what Tiffany does to anyone who even hints at making a sexual comment.
